Terms and Conditions
These Terms and Conditions apply to the warehousing and fulfillment services that Osgec LLC, doing business as Osgec 3PL (“Osgec”, “we”), provides to its clients (“you”). By sending goods to our warehouse or asking us to perform a service, you agree to these terms. If you and Osgec have signed a separate service agreement, that agreement controls where it differs from these terms.
1. Services and prices
We provide the services described on our website, including receiving, storage, FBA and WFS prep, pick and pack, container unloading and return handling. Services are charged at the prices published on our pricing page on the date the service is performed, unless we have given you a written quote. We may update published prices and will give existing clients notice before a change applies to them.
2. Your goods
- You confirm that you own the goods you send us or are authorized to store and sell them, and that they can lawfully be stored, handled and sold in the United States.
- You will give us accurate information about each product, including contents, quantities, weights and any special handling needs.
- You will not send goods listed as not accepted on our website. Goods that need prior approval must be approved by us in writing before you ship them.
- You remain responsible for import clearance, duties, taxes, product compliance, and compliance with the rules of the marketplaces where you sell.
3. Receiving and inventory
We count goods when we receive them and report the result to you. Our receiving count is the starting record of your inventory with us. Please tell us promptly if a receiving report does not match what you shipped.
4. Orders and shipping
Orders we receive by 3:00 PM Eastern Time on a business day are normally shipped the same day. This is a service target, not a guarantee; carrier pickups, volume peaks, weather and events outside our control can cause delays. Once a shipment is handed to a carrier, the carrier is responsible for transit, and claims for loss or damage in transit are made with the carrier.
5. Fees and payment
We invoice for the services performed and for carrier shipping charges. Invoices are payable according to the terms stated on the invoice. If an account is overdue, we may pause services and hold goods until the balance is paid, to the extent the law allows.
6. Care of goods and liability
We handle and store your goods with reasonable care. Our liability for loss of or damage to goods in our care is limited to the amount stated in your service agreement or quote and does not include indirect losses such as lost sales or lost profit. We recommend that you keep your own insurance for goods stored with us.
7. Ending the service
Either of us may end the service by written notice. When the service ends, you will arrange removal of your goods and pay any outstanding balance, including the handling needed to ship the goods out.
8. General
These terms are governed by the laws of the State of Florida. We may update these terms; the current version is the one published on this page.
